On behalf of myself I agree to waive, release, indemnify and hold harmless the Leucadia Hwy 101 Main Street Association and the City of Encinitas and its officers, agents, and employees from and against any and all claims, costs of liabilities, expenses or judgments, including attorney's fees and court costs arising out of my participation in this event and any illness, allergic reaction, food allergy or injury resulting there from except injury deliberately or willfully caused. I recognize that the event can be dangerous to me and accept those dangers. I understand that if I am injured this waiver will be used against me and anyone else claiming damages because of my injury in any legal action. I also understand that this waiver cannot be modified or changed. I acknowledge that volunteers for the event I am attending may not have reliable knowledge about the contents on the food I choose to consume on this night. I understand that I am responsible for the food and beverages I consume and that in the case of an allergic reaction, I will not hold Leucadia 101 Main Street, the participating restaurants nor the City of Encinitas responsible for any damages, injuries or costs associated with legal action.
